 Advice Resolutions curbs large NHS Trust's unlawful practice on breaching the Data Protection Act 2018 /UK GDPR 2018 The NHS Trust in a designated region of the UK has only just rectified our client's inaccurately processed subject access data. Firstly they refused to acknowledge the complaint, secondly they were referred to the Information Commissioners' office who made an adverse finding, and thirdly they conceded their unlawful processing of subject access data. We always have a legitimate expectation as a public law concept that a public authority will always act in accordance of legislation. On this occasion, the NHS Trust needed the ICO's statutory oversight for us to win over the complaint which has taken a little over 5 months to resolve, remarkably. The legislation is primary and enshrined into our laws, laws to be respected, and not at all to be breached with immunity. The public sector can be viewed as a guardian of our inalienable rights but in contrast are prepared to breach them in any event. What can this mean for any of us? Consequential less favourable health decisions leading to lack of prosperity, grossly unjust, and inadequate care provision, because of a lack of correctly tailored services and, of course, leads to poor mental health. Next time we laud the public sector taking charge of running every sector of our society or most for that matter, think again, because we have first blush experience of the lack of fairness and lawful application they are expected to espouse.
